That's a good one, Dave. It's a good start in the right direction. By now, everyone probably already knows my opinion about it, that rather than make laws to control it, they should just make a law to ban it completely.
The article brings up an interesting point which I think can be gotten around. It says it doesn't allow for the average user to sue the company that installed the spyware, only to report it to the FTC. There are some states, however, where an individual can sue on their own. I've been corresponding with a lawyer who has just submitted his suit against MailWiper but for the sake of confidentiality, I can't post details here. He is using the RICO act to do it, and MailWiper definately falls under that law (http://www.ricoact.com). |
